VAN REENEN, R:

Die beskuldigde is gedurende November 2004 te Knysna deur my skuldig bevind aan twee klagtes: een van moord en die ander van verkragting. Beide die klagtes is saamgeneem vir doeleindes van vonnis en die beskuldigde is lewenslange gevangenisstraf opgele.

Na die oplegging van die straf het die beskuldigde homself in die tronk bevind en het uiteraard geen toegang gehad tot die fasiliteite wat nodig is ten einde betyds appel aan te kon teken nie. Hy het homself in 2006 na die Regshulpraad gewend wat horn sedertdien bygestaan het. Daar is verskeie probleme ondervind met die verkryging van die oorkonde van die verrigtinge asook 'n ondertekende uitspraak.

Die feit dat die aansoek vir verlof om te appelleer eers gedurende 14 April vanjaar geliasseer is, het die beskuldigde genoodsaak om die Hof te oortuig dat hy "n saak uitgemaak het vir die kondonasie van die laat liassering daarvan.

Daar is twee hindernisse wat die beskuldigde moet oorkom teneinde met die aansoek om kondonasie te slaag. Die eerste is dat daar 'n aanvaarbare verduideliking verskaf moet word vir die versuim wat hy nou verlang om gekondoneer te word. Die tweede is dat hy moet aantoon dat hy 'n redelike vooruitsig het om te slaag in die verrigtinge wat hy begerig is om voort te sit, naamlik, die appel.

Wat die eerste aspek betref, is ek van mening dat die omstandighede waarin gevonnisdes hulself in die tronk bevind, naamlik 'n ontoeganklikheid tot fasiliteite om betyds appel aan te teken, is ek van oordeel dat hy tog, op 'n balans, 'n saak uitgemaak het. Gevolglik is die enigste oorblywende aspek of hy my oortuig het dat hy 'n redelike vooruitsig op sukses in die beoogde appel het.

Ek het weereens die uitspraak noukeurig nagegaan en my geheue verfris oor die feite waarop dit berus het. Die getuienis was dat daar genetiese materiaal van die oorledene op 'n "boxer" broekie, wat die beskuldigde erken aan horn behoort het en waarskynlik deur horn gedra was toe die misdrywe gepleeg was, gevind is. Die genetiese materiaal het bestaan uit die mengsel van die beskuldigde se eie liggaamsvloeistof en die van die oorledene. In weerwil van hierdie verdoemende verbintenis met die misdryf, het die beskuldigde wat deur 'n prokureur verteenwoordig was, dit goed gedink om nie te getuig nie. Gevolglik is daar niks op rekord wat die duidelike en onvermydelike afleiding op die aangebore getuienis dat hy die persoon is wat hierdie misdrywe gepleeg het bevraagteken of weerle het nie.

In die omstandighede is ek van mening dat die beskuldigde nie daarin geslaag het om my te oortuig dat hy 'n redelike vooruitsig op sukses in die voorgenome appel het nie. Gevolglik is die resultaat dat die aansoek vir kondonasie van die laat liassering van die aansoek om verlof om te appelleer nie kan slaag nie en dat dit van die hand gewys word.

In die omstandighede is dit onnodig om te oorweeg of verlof verleen moet word al dan nie.
