Ratio Decidendi

However, the commissioner exceeded her powers by ordering reinstatement beyond the expiry of the fixed term contract, as there was no evidence of a legitimate expectation for renewal. The commissioner’s authority was limited to the terms of the contract, and by extending the contract, she committed a gross irregularity. The appropriate remedy was compensation for the unexpired portion of the contract, not reinstatement.
