Ratio Decidendi

The Equality Court is a creature of statute and its jurisdiction is strictly limited to matters conferred by the enabling legislation. The applicant's claims arise from an employment relationship and are governed by the Employment Equity Act and Labour Relations Act, which assign exclusive jurisdiction over such disputes to the Labour Court. The applicant cannot circumvent the dispute resolution mechanisms of the Labour Court by approaching the Equality Court. Furthermore, the Court lacks jurisdiction over the seventh respondent, a foreign peregrinus company, as there is no evidence of consent to jurisdiction. The application must therefore be dismissed for want of jurisdiction.
