The Electoral Commission erred in dismissing the Chief Electoral Officer's objections to the nomination of candidates whose names did not appear on the certified voters roll or whose identity documents were invalid. The statutory requirements under the Constitution and the Electoral Act are clear: only adult South African citizens whose names appear on the certified voters roll and who possess valid identity documents are qualified to stand for election. The Commission's decision to allow the nomination of candidates not meeting these requirements was contrary to law. The appeal was upheld and the Commission's decision set aside.
