Procedural Posture

Urgent Application / Interim Relief and Counter Application

  1. 1 Whether the applicants are entitled to use Erf [...] for parking under the amended land use scheme.
  2. 2 Whether the interdict granted against the applicants remains operative after rezoning.
  3. 3 Whether the court has power to suspend the operation of a promulgated amendment scheme pending review.

Ratio Decidendi

The court found that the applicants had established the absence of substantive redress in due course, justifying urgent relief. The rezoning of Erf [...] under Amendment Scheme 20-01-2697 rendered the previous interdict against parking use otiose, as the use is now lawful under the operative land use scheme. The court held that it does not have the power to suspend the operation of a promulgated amendment scheme absent a constitutional challenge. The Residents' conditional counter-application for an interim interdict was dismissed, as lawful exercise of a right cannot be interdicted. Costs were reserved for determination in Part B of the application.

Court Disposition

Declaratory relief granted in favour of the applicants; conditional counter-application dismissed; costs reserved.

Orders

  • It is declared that Erf [...] may be used for parking in terms of Amendment Scheme 20-01-2697 promulgated in Local Authority Notice 342 of 2002 on 9 March 2022.
  • The 1st to 7th respondents’ conditional counter application is dismissed.
