Procedural Posture

Urgent Application / Final Order With Reasons Delivered

  1. 1 Whether the applicant has made out a case for eviction of the respondents.
  2. 2 Whether the respondents hold a valid lien over the occupied houses.
  3. 3 Whether the applicant gave tacit consent for the occupation of the RDP houses.

Ratio Decidendi

The court found that the respondents unlawfully occupied the RDP houses without the Municipality's consent and failed to provide evidence of any contractual relationship or necessary expenses to support a lien. The Municipality complied with all procedural requirements under the PIE Act for eviction. Allegations of corruption and tacit consent were unsupported by evidence. The respondents' conduct amounted to taking the law into their own hands, which is impermissible. The defence of lien was rejected as unsustainable. The Municipality was entitled to an eviction order to restore lawful allocation and prevent further disorder.

Court Disposition

Eviction order granted; respondents ordered to vacate the property.

Orders

  • Eviction of the Fourth to One Hundred and Forty Ninth Respondents and all those occupying through and under them at Modderfontein Farm 76 IR 28 is granted.
  • Respondents and all those claiming occupation through and under them are ordered to vacate the property on or before 30 October 2021.
