Ratio Decidendi

The City's policy was unconstitutional to the extent that it excluded people evicted by private landowners from consideration for temporary accommodation in emergency situations. On a proper reading of Chapter 12 and the housing framework, the City had both the power and the duty to consider and fund emergency accommodation from its own resources where necessary. Because the Occupiers would be rendered homeless by eviction and the City had not shown that it was incapable of meeting their temporary housing needs, eviction was just and equitable only if linked to the City's provision of temporary accommodation on a date before eviction.
