Ratio Decidendi

The adjudicator erred in law by delegating her decision-making authority to an auditor, which is not permitted under the Community Schemes Ombud Service Act. The Act does not empower an adjudicator to transfer core adjudicative functions to a third party, even under the guise of ancillary or ensuing provisions. The High Court, following the reasoning in Baxter v Oceanview Body Corporate, has the power to condone late appeals if the interests of justice so require, despite the statutory time limit. The appeal was upheld, the adjudication order and auditor's report were set aside, and the matter was remitted for proper adjudication in accordance with the Act.
