Procedural Posture

Review Application / Final Judgment on Merits

  1. 1 What is the correct interpretation of condition (c) of the rezoning and subdivision approvals granted by the Municipality on 29 April 2003 and 27 May 2004 regarding the link road?
  2. 2 Did the developer comply with the conditions imposed by the Municipality in respect of the subdivision plans?
  3. 3 Is the Municipality obliged to enforce compliance with the conditions imposed on the developer?

Ratio Decidendi

The court held that condition (c) of the rezoning and subdivision approvals, read with civil condition 11, required the subdivision plans to reflect the entire length of the link road connecting Main Road 233 and Minor Road 45, as indicated in the structure plans. The developer's plans did not comply with this requirement, as they only showed a portion of the road and not the full link. Court Disposition

Declaratory and enforcement orders granted in favour of the applicant; costs awarded as specified.

Orders

  • It is declared that condition (c) of the rezoning and subdivision approvals granted by the Municipality on 29 April 2003 and 27 May 2004 require the subdivision plans to reflect the whole length of the road connecting Main Road 233 from the Golf Club House intersection with Minor Road 45 to the east of Club Mykonos.
  • The first to third respondents are directed to comply with the aforesaid conditions.
