The CCMA was or ought reasonably to have been aware of the reasons for its decisions when taken, and its explanation for the delay was inadequate. The CCMA's reliance on section 217 of the Constitution did not excuse its tardiness, and the interests of justice did not warrant condonation. The delay prejudiced Milestone, which relied on the lease agreement and incurred expenses. The court refused condonation for the late filing of both review applications and ordered the CCMA to pay the costs of the application.
