Ratio Decidendi

Condonation for the late filing of the application for leave to appeal was granted, as the oversight was explained and Coogal did not oppose. However, Sumeil failed to demonstrate reasonable prospects of success on appeal. The court found that there was no evidence that payments made by the Maritz Nel Family Trust were on behalf of Sumeil, and the amounts remained owing to Coogal as of the deemed date of liquidation. The threshold set by section 17(1) of the Superior Courts Act was not met, as Sumeil did not convince the court that another court would reach a different conclusion. Accordingly, the application for leave to appeal was dismissed with costs.
