Procedural Posture

Civil Trial / First Instance

  1. 1 Whether the plaintiff is entitled to recover R650 000 from the defendant under a ceded claim from Standard Bank.
  2. 2 Whether the cession of Standard Bank's claim to the plaintiff was valid and effective.
  3. 3 Whether the payment by the plaintiff to Standard Bank extinguished the defendant's debt to Standard Bank.

Ratio Decidendi

The court found that Standard Bank loaned R650 000 to the defendant, which remained unpaid for nearly four years, constituting more than a reasonable time for repayment. The cession of Standard Bank's claim to the plaintiff was validly executed and supported by credible evidence. The payment by the plaintiff to Standard Bank under the master guarantee indemnified the bank but did not extinguish the defendant's debt, as there was no intention to do so. The plaintiff was therefore entitled to recover the amount from the defendant, with interest at the mora rate from the date of service of summons. Costs were awarded to the plaintiff as per the ordinary rule.

Court Disposition

Plaintiff's claim succeeded in full.

Orders
