Ratio Decidendi

The court held that the fact that the matter raises a novel legal issue regarding an occupier's right to make improvements without the owner's consent does not, in itself, justify granting leave to appeal. The judgment already contains reasoned findings on the merits of the applicant's arguments, which are found to lack substance when considered against the objects and provisions of ESTA. The court found no reasonable prospects that another court would reach a different conclusion and therefore dismissed the application for leave to appeal.
