The commissioner gave undue weight to mitigating factors such as long service and a clean disciplinary record, which, in law, cannot override the gravity of the misconduct in this context. The commissioner also applied the incorrect legal test in assessing the fairness of the dismissal. As a result, the arbitration award was unreasonable and liable to be set aside.
