Ratio Decidendi

The Commissioner did not provide adequate reasons for his award, failing to distinguish between the individual charges and to state clearly which misconduct was found proved. The lack of reasoned analysis and objective justification rendered the award unjustifiable. The procedural irregularities and absence of proper reasoning warranted the setting aside of the award and referral of the matter for a fresh hearing before another commissioner.
