The Supreme Court of Appeal held that neither section 135(4) nor section 143(5) of the Companies Act 71 of 2008 creates a 'super-preference' for the business rescue practitioner's remuneration and expenses over secured creditors upon liquidation. The preference granted is limited to the free residue after liquidation costs and does not extend to assets subject to security. The effective date of liquidation is the date the liquidation application is filed, not the date business rescue commenced.
