On the facts, the plaintiff either failed to keep a proper lookout or was driving too fast, as he could not avoid the collision despite good visibility and similar speeds between the vehicles. The insured driver, Mr. Mawila, was not found to be negligent, as there was no evidence that his actions contributed to the accident or that he could have avoided the collision. The plaintiff failed to discharge the onus of proving negligence on the part of the insured driver. Accordingly, the claim was dismissed.
