Procedural Posture

Condonation Application / Application for Condonation for Late Referral; Jurisdictional Challenge

  1. 1 Whether the Labour Court has jurisdiction over the applicants' claims.
  2. 2 Whether the late referral of the statement of case should be condoned.
  3. 3 Whether the applicants' claim constitutes an employment dispute or a commercial dispute.

Ratio Decidendi

The Labour Court lacks jurisdiction to entertain the applicants' claim as there was no referral to the CCMA for conciliation in respect of an alleged unfair dismissal. Furthermore, the applicants' claim is not employment-related but arises from a commercial joint venture dispute, which falls outside the Labour Court's jurisdiction. The application for condonation is therefore dismissed. The conduct of the applicants' representative, Mr Tlali, constituted an abuse of process, and he is ordered to pay the costs in his personal capacity.

Court Disposition

Application dismissed for want of jurisdiction; costs awarded against the applicants' representative in his personal capacity.

Orders

  • The application is dismissed for want of jurisdiction.
  • Costs are awarded against Mr ME Tlali in his personal capacity.
