Ratio Decidendi

The court found that the commissioner was faced with two conflicting versions of events and made a credibility finding in favour of the fourth respondent. The commissioner concluded that there was suspicion of dishonesty but no hard evidentiary facts to support a finding of misconduct. The court held that credibility findings by a presiding officer are rarely disturbed unless clearly unsustainable, and found no misdirection or irregularity in the proceedings. Accordingly, the application for review could not succeed.
