Ratio Decidendi

The Electoral Commission's failure to record all available voters' addresses on the national common voters' roll was unlawful and inconsistent with its constitutional rule of law obligations; because the omission affected the upcoming municipal elections and the Commission could not timely cure the defect without jeopardising elections, the Court dismissed the appeal but granted direct access and suspended the invalidity, requiring the Commission to obtain and record all reasonably available post-17 December 2003 addresses by 30 June 2018, with a Tlokwe exception and supervisory reporting.
