Procedural Posture

Interlocutory Application / Judgment

  1. 1 Is the first respondent liable to pay mora interest on the purchase price due to unreasonable delay in transfer of the property.
  2. 2 Did the delay in registration and payment result from the first respondent's internal administrative issues.
  3. 3 Is the applicant entitled to interest from the date of demand until payment.

Ratio Decidendi

The court found that the first respondent was placed in mora by the applicant's written demand on 27 June 2022. The delay in registration of transfer and payment of the purchase price was caused by the first respondent's internal administrative issues, and no acceptable reasons for the undue delay were provided. In terms of the settlement agreement, the applicant was entitled to demand performance, and the first respondent's failure to comply within the stipulated timeframes triggered liability for mora interest under the Prescribed Rate of Interest Act. The court rejected the respondent's submissions and held that the applicant is entitled to interest from the date of demand until payment.

Court Disposition

Application granted. The first respondent is liable to pay interest on the purchase price from 27 June 2022 to the date of payment and costs on a party and party scale.
