The applicant failed to show that the shareholding of Cachalia JA, the prior association of Cachalia and Malan JJA with Absa Bank, the conduct of the presiding judge during argument, or the Supreme Court of Appeal’s factual findings gave rise to a reasonable apprehension of bias. The shareholding was too small to realistically affect the outcome, there was no material basis for recusal on prior association, the courtroom conduct amounted at most to irritation or robustness, and the challenged factual findings were supported by the record. The late bias complaint was also not in the interests of justice to entertain after judgment. Accordingly, the appeal was dismissed.
