The Court found that the servitude must be interpreted in accordance with the wording of the option agreement and the notarial deed. Both documents expressly prohibit construction within 27.5 meters of the centre line of the powerline, which logically results in a servitude 55 meters wide, split equally on either side of the centre line. Eskom's interpretation would result in a servitude of 82.5 meters, which contradicts the agreement. The Court rejected Eskom's expert evidence as irrelevant to the core issue and accepted the respondents' expert report, which engaged directly with the interpretation of the servitude.
