Ratio Decidendi

The Supreme Court of Appeal held that the statutory definition of 'pension interest' in the Divorce Act applies only to the value of the interest a member has at the date of divorce, calculated as if membership terminated due to resignation on that date. In this case, Krugel had already resigned and deferred his pension benefit long before the divorce, so he no longer had a pension interest as contemplated by the Divorce Act at the time of divorce. The provisions of ss 7(7) and 7(8) of the Divorce Act and s 37D(4)(a) of the Pension Funds Act were therefore not applicable.
