Procedural Posture

Review Application / Interlocutory Application to Dismiss Review and Condonation for Late Filing of Record

  1. 1 Whether the review application is deemed withdrawn or archived under the Practice Manual provisions.
  2. 2 Whether the Labour Court can entertain a condonation application when the review is deemed withdrawn or archived.
  3. 3 Whether the lapse of the final written warning renders the review application moot.

Ratio Decidendi

The Labour Court held that the review application was deemed withdrawn or archived in terms of the Practice Manual due to the third respondent's failure to prosecute the matter expeditiously and to file the record within the prescribed period. No application for reinstatement was made, and the condonation application could not be entertained in the absence of a live review application. Additionally, the final written warning that formed the subject of the review had lapsed, rendering the dispute moot and academic. The Court concluded that there was no live controversy and struck the Rule 11 application off the roll, dismissing the application to reinstate the review.

Court Disposition

Review application remains withdrawn or archived and is defunct. Rule 11 application is moot and struck off the roll. Application to reinstate the review is dismissed. No order as to costs.

Orders
