Ratio Decidendi

The applicant failed to establish, on the papers, that the credit agreement with the respondent included a clause retaining ownership of the vehicle. The respondent's version, that he only signed the first and last pages and was not made aware of any retention of ownership, was not adequately addressed or refuted by the applicant. The applicant did not respond to the core issue raised by the respondent and failed to explain discrepancies between versions of the agreement. In motion proceedings, the applicant must make out its case in the founding affidavit, and its failure to do so is fatal. The application for the return of the vehicle based on retention of ownership is dismissed.

Court Disposition

Application dismissed with costs.
