The Labour Appeal Court found that the arbitrator and Labour Court failed to properly consider the evidence that the first respondent knowingly breached a clear prohibition against reversing charges on his personal account using privileged access. The respondent's conduct constituted a serious breach of trust and disregard for bank procedures. Although the charge may not have been perfectly drafted, it was sufficiently clear for the respondent to understand the substance of the misconduct. The respondent's subsequent conduct, including lack of remorse and acrimonious attitude, further undermined the employment relationship. Given the breakdown of trust, reinstatement was not appropriate....
