The court found that the plaintiff delivered the required notice in terms of section 129, both under the Act and the bond agreement, and that the defendants' payments did not purge their default. The invocation of section 26 of the Constitution did not provide a valid defence, as the right to housing does not prevent enforcement of a mortgage bond. The defendants failed to establish a bona fide defence, and summary judgment was granted.
