Procedural Posture

Civil Appeal / Appeal From Full Court of the Transvaal Provincial Division

  1. 1 Whether the interest income received by the appellant during the 1987 and 1988 tax years was from a source within the Republic of South Africa as defined in section 1 of the Income Tax Act 58 of 1962.
  2. 2 Whether the appellant's objection to the inclusion of the interest amounts in its gross income was valid.

Ratio Decidendi

The court held that although the foreign currency was made available and repaid in New York, the dominant cause of the interest income was the appellant's business activities in South Africa. The agreements, client relationships, and operational structures that generated the interest income were all based in South Africa. The substance of the transaction, rather than the mere location of the funds, determined the source of the income. Applying the principles from Essential Sterolin and Lever Bros, the court found that the source of the interest income was within South Africa, and the amounts were correctly included in the appellant's gross income for tax purposes.

Court Disposition

Appeal dismissed with costs, including costs of two counsel.

Orders

  • The appeal is dismissed with costs, including the costs of two counsel.
