Ratio Decidendi

The Supreme Court of Appeal held that Mrs Duvenhage failed to establish a causal connection between Roux's negligent conduct and the losses claimed. The evidence did not show that a loan would have been granted had the application been submitted, nor that the venture would have succeeded. The project was doomed from the outset due to the expiry of the permits and the impossibility of completing the planting in time. The losses were not caused by Roux's conduct but by the inherent impossibility of the venture. Accordingly, both the contractual and delictual claims failed for want of causation, and the bank was not liable for the damages claimed.
