The respondent was aware of this retraction but nevertheless intended to proceed with the broadcast. On a prima facie basis, the applicants established that the broadcast would be based on incorrect information and that they would suffer harm if it proceeded. The court held that there was no irreparable prejudice to the respondent if the order was granted and that the balance of convenience favoured the applicants. Accordingly, the applicants were entitled to the urgent interdict sought.
