The Court found that the Plaintiff was not mala fide in seeking the amendments, and the initial omission of relevant averments did not amount to malice. The amendments were necessary to properly ventilate the dispute and allow the Defendants to plead to the allegations, including suretyship liability. The objection that the amendments would resuscitate a prescribed claim was rejected, as prescription was interrupted by service of summons, and the damages component was postponed sine die pending the return and valuation of the goods. The amendments did not introduce a new cause of action but clarified the liability of the sureties, which was already contemplated in the original pleadings....
