The court found that the Council for Debt Collectors, acting through Mr Mokondo, was functus officio after issuing its decision of 17 August 2021, which was communicated to the affected parties. Regulation 7(7) did not confer any power to vary or revoke a final decision. The subsequent reconsideration and revised decision of 23 August 2021 were therefore ultra vires and invalid. Furthermore, the process leading to the revised decision was procedurally unfair, as Silverbirch was excluded from communications and denied an opportunity to respond, contravening section 6(2)(c) of PAJA.
