The Supreme Court of Appeal held that the housing development scheme was registered over the entire property, as evidenced by the consolidated title deed and the terms of the sale agreement and levy payments. The rights of occupation and interests of the life-right holders extend to the whole property and not merely to their individual units. Section 4B of the Housing Development Schemes Act clearly prohibits the alienation of any part of the property without the consent of at least 75% of the holders of rights of occupation.
