Ratio Decidendi

The Court held that the Amended Treaty and Tribunal Protocol bound South Africa and Zimbabwe; Zimbabwe had submitted to the Tribunal’s jurisdiction and waived immunity for enforcement purposes; and the common law had to be developed so that the Tribunal would be treated as a foreign court for enforcement of its orders. On that basis the High Court had jurisdiction to register and enforce the costs order, so the rescission challenge failed and the appeal was dismissed.
