Although the respondent's office lacked authority to grant such extensions, both parties operated under a genuine common mistake of law. The Tribunal held that the explanation for the delay was adequate and that none of the remissness could be attributed to the appellant. There was no evidence of prejudice to the respondent, which had effectively consented to condonation by granting extensions. The Tribunal concluded that good reason existed for condonation and that the appeal should be rescheduled for hearing.
