The court found that the arbitrator failed to resolve the central factual dispute regarding the language used in the disciplinary hearing and did not properly assess the credibility and reliability of the witnesses. The arbitrator's reasoning was inadequate, as he did not explain why he preferred the Third Respondent's version over that of Nell and Jones, nor did he address corroborating documentary evidence. Applying the Sidumo test, the court held that the arbitrator's conduct fell outside the band of reasonable decisions and rendered the award reviewable.
