Procedural Posture

Review Application / Judgment Delivered After Opposed Motion Proceedings

  1. 1 What is the correct interpretation of clause 2.3 of Annexure C to the Vaalriver Complex Guide Plan regarding subdivision of land bordering the Vaal River.
  2. 2 Does clause 2.3 prohibit the first respondent from approving the proposed subdivision of the Remainder of the Farm Luciana No. 214.

Ratio Decidendi

The court held that clause 2.3 of Annexure C to the Vaalriver Complex Guide Plan requires that the width of the waterfront boundary of any property, measured horizontally, must be at least 100m, except for existing properties. The proposed subdivision does not create a new property with a river frontage less than 100m, nor does it affect the river frontage of the remainder of the farm. Therefore, the clause does not prohibit the first respondent from considering the application on its merits. The respondent's refusal was based on a misinterpretation of the clause, and the application for review succeeds.

Court Disposition

Application for review granted in terms of prayers 1 and 3 of the Notice of Motion. Costs awarded to applicant on a reduced basis.
