The responsible authority did not provide cogent reasons for refusal and ignored evidence that the surrendering land would remain viable and the receiving property required the water. The statutory scheme under section 25(2) of the National Water Act does not require an application for surrender, only notification, and the responsible authority is obliged to consider the merits independently. The appeal succeeded because the refusal was not based on lawful or rational grounds.
