Actebis 141 CC, represented by Mr Labuschagne, was the true seller. Mr Hutchinson breached the agreement by capturing three colour variant blesbuck, which were not sold to him and were worth substantially more than the agreed price. This material breach entitled Actebis to cancel the agreement.
