Ratio Decidendi

However, the order granting Ensemble leave to intervene was appealable, as its success would resolve the real issue between the parties regarding Ensemble's interest in the proceedings. The court accepted that Ensemble's tacit hypothec was lost upon removal of the goods, and absent evidence of fraud or collusion, Ensemble had no further interest. Nonetheless, the appeal on the intervention order was allowed to proceed to the Full Bench, while leave to appeal the rescission order and other prayers was refused.
