Ratio Decidendi

The applicants would suffer irreparable harm if evicted from their homes, whereas Mr Mailula would not suffer material or irreparable harm if the execution order were suspended; because the matter implicates constitutional rights and the High Court granted execution without regard to PIE, the appropriate relief was to suspend the execution order pending the appeal and refer the leave-to-appeal issue to the Supreme Court of Appeal.
