In CCT 182/17, the Basson orders were only effective while the interim regime deriving from the earlier court orders remained in force; once this Court in Tasima I confirmed that the extension agreement was invalid retrospectively to 23 June 2015, the legal basis for those orders fell away, so the State parties were not obliged to pay payment certificate 113 or later requisitions and the High Court's contrary interpretation was wrong. In CCT 240/17, Tasima's appeal was moot because it sought only a declaratory interpretation of an order whose practical consequences had already been executed, and granting leave would have no practical effect; the Court also considered the matter to lack a...
