The order granted by Fabricius J was made by agreement between the parties, which concluded the matter. The notice of default complied with section 129(1)(a) of the National Credit Act and the relevant clauses of the home loan agreement. The plaintiffs' reliance on further demands and specific clauses was misplaced, as those provisions did not apply to the facts of the case. The particulars of claim were found to be vague and embarrassing, as the annexures contradicted the averments made. Accordingly, the exception was upheld.
