Ratio Decidendi

The court found that the commissioner committed gross irregularities by accepting the third respondent's version of procedural unfairness without it being put to the applicant's witnesses and without corroboration. The commissioner ignored documentary evidence, including sworn statements from affected customers, and failed to make credibility findings. The award was not rationally justifiable on the reasons given, and the commissioner failed to appreciate the true issues in dispute. These irregularities denied the applicant a fair hearing and justified the review and setting aside of the arbitration award.
