Procedural Posture

Application for Leave to Appeal and Appeal / Constitutional Court Judgment on Leave to Appeal and Merits After Supreme Court of Appeal Dismissal

  1. 1 Whether a letter of request under section 2(2) of the International Co-operation in Criminal Matters Act 75 of 1996 may be issued to obtain original documents when copies are already held by the NDPP.
  2. 2 Whether section 2(2) was available after the criminal proceedings had been struck from the roll and before re-indictment.
  3. 3 Whether the issuing of the letter of request infringed Mr Zuma's rights to dignity, a fair trial, and access to courts.

Ratio Decidendi

The Court held that section 2(2) of the Act was lawfully invoked because the request for the original documents and authenticity statements was made during an investigation, the fact that copies were already held did not remove the request from the scope of 'information', and the fact that the earlier prosecution had been struck from the roll meant the proceedings were no longer pending. The Court further held that the issuing of the letter of request did not infringe Mr Zuma's dignity, fair trial rights, or access to courts because any challenge to admissibility and fairness could be raised at trial. Accordingly, the appeals were dismissed.
