Ratio Decidendi

The impugned Acts are reasonably capable of a constitutionally compliant interpretation: the word 'spouse' includes the surviving partner to a monogamous Muslim marriage, and 'survivor' includes the surviving partner to a monogamous Muslim marriage. On that interpretation the Acts are not unconstitutional, so the High Court's invalidity order should not be confirmed and the applicant is entitled to declaratory relief recognizing her as a spouse and survivor under the Acts.
