The court found that the applicant failed to establish urgency as required by Rule 6(12)(b), given the unexplained delay in bringing the application and the fact that the applicant continued operations despite the freezing of its bank account. The unlawful attachment of the account did not, on its own, render the matter urgent. Furthermore, the failure to join Mr JJ Swart, who has a direct and substantial interest as a trustee and member of the applicant, was fatal to the application.
