The court found that the Arbitrator committed gross irregularities in the conduct of the arbitration proceedings by failing to allow the Third Respondent to testify under oath, denying the applicant the opportunity to cross-examine her, restricting the applicant from calling relevant witnesses, and failing to allow closing argument before delivering the award.
