Ratio Decidendi

The Court found that the RAF did not properly plead prescription in its original plea and failed to effect the amendment to introduce a special plea of prescription in accordance with Rule 28. The plaintiff’s claim was based on section 17(1)(a) of the Road Accident Fund Act because the identity of the driver was established and recorded in the Accident Report Form. The absence of the driver’s details in the RAF1 form did not render the claim prescribed under Regulation 2(1)(b). The Court held that the claim did not prescribe and dismissed the special plea. The RAF conceded liability subject to prescription, and the parties settled the quantum, with the matter referred to the settlement roll.
